ATI Faces Class Action Lawsuit Over Misleading HDCP Compatibility Claims


ati radeonAs hi-def standards quickly move into the mainstream and with HD-DVD and Blu-ray finally hitting the market, it is important to many consumers that they have all the information they need to make the best purchasing decision they can to prepare for these technologies. When mislead, consumers will fight back and, according to The Inquirer, ATI is about to find out how far the consumer will go to make sure companies play fairly. In a filing made by Stanley Batsalkin and Kenny Vargas in San Jose district court, the duo allege that ATI (and it’s various divisions) “…breached state consumer protection statutes, express warranty statures, implied warranty statutes, negligent misrepresentation common laws and unjust enrichment common laws.” The heart of the filing is ATI’s mis-representation that their cards were HDCP ready or HDCP compliant.

It’s important to note that ATI no longer makes these claims about their cards. The plaintiffs, however, claim that had they known the truth, they wouldn’t have bought the products. The problem for ATI is that many of their cards were indeed labeled HDCP ready or compliant before HDCP standards were even finished. Whether the case will hold up in court is another matter. The plaintiffs intend on taking the issue to a jury trial.
